These purchase terms apply to all purchases of products and services from TheMemorialStone ApS. The terms supplement our general terms and conditions.

2. Products and Services

We sell the following products and services:

• Digital memorial pages (free and premium subscriptions)
• QR codes for memorial stones with personal memorial links
• Physical memorial stones with QR code integration
• AI-generated memorial songs via Suno

3. Prices and Payment

All prices are quoted in Danish kroner (DKK) and include VAT unless otherwise stated. We accept the following payment methods:

• Payment cards (Visa, Mastercard, etc.) via Stripe
• MobilePay (where available)
• Invoice for business customers and resellers by agreement

4. Right of Withdrawal

In accordance with Danish consumer law, you as a consumer have a 14-day right of withdrawal from the day you receive the goods or accept the service.

When exercising the right of withdrawal, you must return physical goods in the same condition and quantity as you received them. We will refund all payments, including delivery costs (but not any additional costs resulting from your choice of a delivery method other than the cheapest standard delivery), without undue delay and in any case no later than 14 days from the day we received notice of your decision to withdraw from the purchase.

5. Delivery

Delivery time depends on the product:

• Digital services and QR codes: Delivered immediately after payment. You will receive a confirmation email with access to your memorial page and any QR codes.
• Physical memorial stones: Delivery time is normally 4-8 weeks from order, depending on production and engraving. You will receive an expected delivery date when ordering.
• Physical QR code plates: Shipped within 3-5 business days after payment via standard mail or freight company.

6. Payment Terms

Payment must be made at the time of ordering unless otherwise agreed:

• One-time purchases are paid immediately at checkout via Stripe
• Subscriptions are charged automatically monthly/annually depending on the plan chosen
• Invoices for business customers must be paid within 14 days of the invoice date
• In case of non-payment, we reserve the right to suspend or deactivate services

7. Shipping

Shipping costs are added at checkout and depend on the size and weight of the item and delivery location:

• Physical memorial stones: Delivered to the specified address. Freight costs are calculated individually based on stone size, weight, and destination.
• Delays: We strive to meet all delivery times but cannot be held responsible for delays caused by force majeure, strikes, transport problems, or other circumstances beyond our control.

8. Right to Complain

You have a 24-month right to complain in accordance with Danish consumer law on physical products. The right to complain covers material defects and shortcomings that existed at the time of delivery.

Complaints must be made in writing to contact@thememorialstone.com with a description of the defect and pictures if relevant. We will then assess the case and inform you of our decision as soon as possible.

9. Warranties

We provide the following warranties on our products:

• TheMemorialStone warranties: We guarantee that all physical memorial stones are made of high-quality materials and produced with care. However, we do not guarantee natural variations in stone and materials.
• Customer responsibility: The warranty does not cover damage resulting from incorrect use, accidents, weather impact, or lack of maintenance. The customer is responsible for appropriate maintenance of physical memorial stones.

10. Liability and Limitation of Liability

We are liable for direct losses that you suffer as a result of errors or omissions on our part. We are not liable for indirect losses, including lost earnings, data or goodwill, unless the loss was caused by gross negligence or intent.

11. Force Majeure

We are not responsible for failure to fulfill our obligations if this is due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, strikes, lockouts, public intervention, energy shortages, or telecommunications failures.
